If you own a rental property built before 1978, you are required by the Rhode Island Department of Health (RIDOH) to obtain a Certificate of Lead Conformance (CLC). The CLC is issued to a landlord once their rental property is deemed “lead safe”. A rental property is considered lead safe following a successful Lead Hazard Mitigation Inspection (LHM) by a licensed RI lead inspector.

For a LHM to successfully pass, the paint condition on painted surfaces throughout the rental property must be intact which means no chipping, flaking, or peeling; if paint is found in poor condition, the paint can be tested and identified as not lead based.

If paint is found damaged AND lead based, further action is required by the rental owner before a CLC can be issued. It should be noted that not every lead inspector has the equipment needed to perform on-site testing of paint. There are lead inspectors who will simply mark a painted surface as damaged and assume the paint is lead based without conducting additional testing. We would never assume damaged paint to be lead based because it will equate to more money coming out of your pocket in the form of abatement costs.
